Terms of service.

The agreement between Dev Jins, the maker of Sync Notify, and the merchants who use it: how the service works, plans and billing, acceptable use, suspension, data processing and the limits of our liability.

LAST UPDATED 4 October 202614 SECTIONS

Agreement

Sync Notify is a product of Dev Jins (devjins.com), a business based in Pakistan. These Terms of Service ("Terms") are an agreement between Dev Jins ("we", "us", "our") and the business that installs the Sync Notify app on a Shopify store ("merchant", "you"). They are effective from 4 October 2026.

By installing or using Sync Notify you accept these Terms and our Privacy Policy. Sync Notify is for business use only. You confirm that you are at least 18, that you use the app for your business and not as a consumer, and, if you install it for a business, that you are authorised to accept these Terms for it. If you do not agree, do not install or use the app.

Terms of use

The service

Sync Notify is a Shopify app that sends automated emails, as single emails or multi-step sequences, when Shopify events happen or on a schedule. Emails to your customers are sent through the SMTP email account that you connect. Sync Notify does not operate an email sending service of its own.

"Unlimited emails" means Sync Notify does not charge or cap you per email or per contact on any plan. Your SMTP provider sets its own sending limits and decides whether to accept or deliver each email. Email above your configured limits waits in a queue and is sent when the limits allow.

Your account, store and SMTP account

  • You need an active Shopify store. Access to the app is through Shopify; there is no separate Sync Notify login.
  • You must connect and test a working SMTP account before sending starts. You are solely responsible for that account, its credentials, its cost, and following your provider's terms and sending limits. Setting limits in Sync Notify that are higher than your provider allows is at your own risk.
  • You are responsible for the accuracy of your store details, including the store name and postal address shown in every email footer.
  • You are responsible for activity under your store, including by your staff, and for keeping access to your Shopify admin secure.

Your content and data

You keep ownership of your templates, branding, store data and customer data. You give us permission to host, copy, process and send that content only as needed to provide the service to you. You are responsible for your email content, your customer lists and the consent you hold, and you confirm that you have the rights and permissions needed for us to process them. For your customers' personal data, you are the controller and we are your processor, under the Data Processing Addendum below.

Our service and intellectual property

Sync Notify, including its software, starter templates, website and brand, belongs to Dev Jins. We give you a limited, non-exclusive, non-transferable, revocable right to use the app for your store while these Terms apply. You may not copy, resell, sublicense, reverse engineer or build a competing product from the service, except where the law allows it despite this restriction. If you send us feedback, we may use it without any obligation to you.

We may change, improve or remove features. We will tell you in advance about changes that materially reduce a paid feature you rely on.

Plans and billing

  • Sync Notify offers Free, Pro and Advanced plans. What each plan includes and its current price are listed on the Pricing page. At the time of writing, Pro is USD 12 a month and Advanced is USD 29 a month.
  • Annual plans are charged at ten times the monthly price, which gives two months free.
  • All charges are billed through Shopify Billing and appear on your Shopify invoice. Shopify handles payment, proration and applicable taxes, and Shopify's own terms apply to those payments.
  • Every new store receives one 14-day free trial of the Advanced plan. No charge or payment approval is needed to start it. The trial is given once per store domain; reinstalling the app does not restart it.
  • When the trial ends, your store moves to the Free plan unless you have chosen a paid plan. If you choose a paid plan during the trial, billing starts when the trial ends. If you cancel the paid plan or uninstall before the trial ends, you are not charged.
  • Downgrading, or the end of a trial, pauses features above your new plan; it does not delete them. Customers already inside a paid-plan sequence finish its remaining steps, and no new customers enter it until you upgrade again.
  • Paid plans renew automatically each billing period until you change plan or uninstall the app. Uninstalling stops future charges.
  • Refunds: charges are billed by Shopify and are not refunded for partial billing periods, unused time or a downgrade, except where the law requires a refund. A store suspended or terminated for breaking these Terms is not entitled to a refund.
  • We may change prices with 30 days' notice by email and in the app. A new price applies from your first billing period that starts after the notice period ends. If you do not accept it, you can downgrade or uninstall before then.

Acceptable use

You must use Sync Notify lawfully and only to email your own store's customers. You must follow the email and privacy laws that apply to you and your customers, including CAN-SPAM (United States), CASL (Canada), the GDPR and UK GDPR (European Union and United Kingdom), US state privacy laws and the Prevention of Electronic Crimes Act 2016 (Pakistan).

No spam. In particular, you must not:

  • Send marketing emails to anyone who has not given the consent required by law, or who has unsubscribed or been suppressed.
  • Import, buy, rent or scrape email lists, or email people who are not your store's customers.
  • Use false or misleading sender names, From addresses, subject lines or content.
  • Remove, hide or work around the store address and unsubscribe footer, or delay acting on unsubscribe requests.
  • Send content that is illegal, fraudulent, deceptive, harassing, hateful, sexually explicit involving minors, or that infringes others' rights.
  • Send phishing, malware or links to harmful sites.
  • Try to get around plan limits, sending limits or security controls, access data or systems without permission, or interfere with the service or other stores.

Suspension and termination

We monitor signs of abuse, such as high bounce or unsubscribe rates and complaints. If we reasonably believe a store is breaking these Terms, putting recipients, providers or the service at risk, or breaking the law, we may suspend sending for that store.

  • A suspended store sends no emails until we lift the suspension. Queued emails are held, not sent.
  • Where we can, we will tell you the reason and what to fix. For serious or urgent abuse we may suspend first and contact you afterwards.
  • You can ask us to review a suspension by contacting support@syncnotify.com.
  • We may end these Terms and your access for serious or repeated breaches, or if we stop offering Sync Notify, in which case we will give you at least 30 days' notice.

You can stop using Sync Notify at any time by uninstalling the app. After uninstall, your store's data is deleted as described in our Privacy Policy. Sections that by their nature should survive, including fees owed, disclaimers, liability limits, indemnity and governing law, continue after these Terms end.

Third-party services

Sync Notify depends on Shopify and on the SMTP provider you choose. Their services are governed by their own terms between you and them. We are not responsible for their availability, their sending limits, or their decisions to reject, filter, block, rate-limit or not deliver email, or to suspend your account with them.

Availability and disclaimers

We work to keep Sync Notify available and reliable, but we do not guarantee uninterrupted or error-free service. We may carry out maintenance, and will try to schedule it to limit disruption.

To the extent the law allows, the service is provided "as is" and "as available", and we disclaim all warranties and conditions not stated in these Terms, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that any email will be delivered, reach the inbox, be opened or be clicked, or that you will earn any revenue. Revenue and attribution reports are estimates based on your attribution settings, and open rates can be inflated by mail privacy features.

Limits of liability

To the extent the law allows:

  • Neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, sales, data or goodwill, even if it was told they were possible.
  • Our total liability for all claims relating to Sync Notify or these Terms is limited to the fees you paid for Sync Notify in the 12 months before the event that gave rise to the claim, or USD 100, whichever is greater.
  • We are not liable for losses caused by your SMTP provider, Shopify, email deliverability, blocks or limits set by email providers, your content, your customer lists, or your breach of these Terms or the law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud or for death or personal injury caused by negligence. Where the law does not allow a limit, the limit applies to the greatest extent the law permits.

Indemnity

You will defend and indemnify Dev Jins against third-party claims, fines, losses and reasonable costs, including legal fees, arising from your emails and their content, your customer lists and the consent you hold, your SMTP account and its use, your use of customer data, or your breach of these Terms or the law. We will tell you promptly about any such claim, let you control its defence, and give you reasonable help at your cost. You may not settle a claim in a way that admits fault by us without our written consent.

Data Processing Addendum

Scope and roles

This addendum applies when we process personal data of your store customers for you, and forms part of these Terms. It meets Article 28 of the GDPR and UK GDPR and the service provider terms of the CCPA/CPRA. You are the controller and Dev Jins is the processor (and service provider). If this addendum conflicts with the rest of these Terms, this addendum wins; if it conflicts with the Standard Contractual Clauses, the clauses win.

Subject matter and duration
Providing Sync Notify to you, for as long as the app is installed and until the data is deleted as set out below.
Nature and purpose
Storing, syncing, analysing and sending emails based on your store's data, tracking opens and clicks, attributing orders, and handling unsubscribes and privacy requests.
Data subjects
Your store customers, including people who start a checkout.
Types of data
Name, email address, marketing consent status, language, tags, country and city, order and checkout details, email activity including IP address and device type, and unsubscribe and suppression status. No special categories of data.

Our commitments

  • We process the data only on your documented instructions, which are these Terms and the settings you choose in the app, unless the law requires otherwise. We will tell you if we believe an instruction breaks data protection law.
  • We do not sell or share the data, and we do not keep, use or disclose it for any purpose other than providing the service to you, or combine it with data from other stores or sources, except as the law allows.
  • Everyone at Dev Jins who can access the data is bound by confidentiality.
  • We keep the technical and organisational security measures described in our Privacy Policy, including encryption in transit and at rest for credentials, store isolation, two-factor authentication and audit logs for staff access, and encrypted off-site backups.
  • We help you, as far as we reasonably can, to answer data subject requests (including through Shopify's privacy webhooks), and with security, breach notification, impact assessments and consultations with authorities.
  • We notify you without undue delay, and where possible within 72 hours, after becoming aware of a personal data breach affecting your store customers' data, with the information you need to meet your own obligations.
  • When the app is uninstalled, we delete the data after Shopify's store deletion request (about 48 hours later); it is gone from backups within 14 days.
  • We make available the information needed to show that we meet this addendum. Once a year, on 30 days' written notice, you may audit our compliance by written questions or by an independent auditor bound by confidentiality, at your own cost.

Sub-processors

You give general authorisation for us to use the sub-processors listed in our Privacy Policy. We bind each one by a written contract with data protection terms at least as protective as this addendum, and we remain responsible for them. We will give at least 30 days' notice of a new sub-processor by email or in the app. If you object on reasonable data protection grounds and we cannot address your concern, you may end these Terms by uninstalling the app, and any prepaid fees for the period after that will be refunded.

International transfers

The data is hosted in the European Union and accessed by our team in Pakistan. For transfers of personal data from the European Economic Area or Switzerland to a country without an adequacy decision, the Standard Contractual Clauses adopted by the European Commission in Decision 2021/914 are incorporated into these Terms: Module Two (controller to processor) between you and us, and Module Three (processor to processor) where we use sub-processors. Clause 7 does not apply, Option 2 (general authorisation, with 30 days' notice) applies under Clause 9, the optional wording in Clause 11 does not apply, and Clauses 17 and 18 refer to the law and courts of Ireland. The annexes are completed by this addendum and our Privacy Policy. For transfers from the United Kingdom, the UK International Data Transfer Addendum issued by the Information Commissioner applies to those clauses.

General terms

Force majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control, such as natural disasters, war, internet or power failures, failures of Shopify, hosting or email providers, or actions of governments. This does not excuse payment of fees owed.
Severability
If any part of these Terms is found invalid or unenforceable, it is changed to the minimum extent needed to make it enforceable, and the rest stays in effect.
Entire agreement
These Terms, including the Data Processing Addendum, and our Privacy Policy are the whole agreement between you and us about Sync Notify and replace any earlier understanding.
Assignment
You may not transfer these Terms without our written consent. We may transfer them as part of a sale or reorganisation of our business, and will tell you if we do.
No waiver
If we do not enforce a right straight away, we do not give it up.
Notices
We send notices to your store's contact email and in the app. You send legal notices to support@syncnotify.com. These Terms are written in English, and the English version governs.

Governing law

These Terms are governed by the laws of Pakistan. Disputes will be handled by the courts of Pakistan, unless the law where you are based gives you a right that cannot be removed by contract to bring a claim locally. Before starting a claim, each party will try in good faith to resolve the dispute by email for 30 days.

Changes to these Terms

We may update these Terms. We will post the new version here with a new effective date and, for material changes, tell you in the app or by email at least 30 days before they take effect, unless a change is needed sooner for legal or security reasons. Continuing to use Sync Notify after that means you accept the updated Terms. If you do not accept them, uninstall the app before they take effect.
